Here is a New York Times story about broccoli, or rather, about what broccoli has to do with the constitutionality of ObamaCare. The following three propositions are logically inconsistent:
- If ObamaCare's individual mandate is constitutional, then a law that requires Americans to buy broccoli is constitutional.
- A law that requires Americans to buy broccoli is unconstitutional.
- ObamaCare's individual mandate is constitutional.
Any two of these propositions entail the falsity of the third. Everyone, therefore, must reject at least one of the three propositions. I reject 3. Paul Krugman, evidently, rejects 1. Erwin Chemerinsky, evidently, rejects 2. Charles Fried rejects 2.
